Using this site and these terms

These terms cover your use of this website and the masonry and concrete work Sterling Santa Fe Concrete & Masonry does for homeowners and property owners in Santa Fe, NM and the cities around it. By using the site, asking for an estimate or booking work with us, you agree to these terms.

If a written estimate or contract we both sign says something different from this page, the signed document controls for that job. If you don't agree with these terms, please don't use the site or book work through it.

What we do

We're a masonry contractor in Santa Fe, NM. Our work includes foundation and block walls, brick and stone repair, tuckpointing, chimneys, fireplaces, retaining walls, pavers, walkways and outdoor kitchens. The service pages on our home page describe each one in general terms.

Those descriptions explain the work. They aren't a promise that a given method, material or result fits your property. What we'll do on your job is set out in your written estimate or contract after we've seen the site.

Estimates and pricing

Estimates are free and come with no obligation. We give them after looking at the job in person, because access, soil, the condition of existing masonry and the materials you choose all change the price.

An estimate covers the work it describes, based on what we can see before the job starts. If we open up a wall, footing or chimney and find hidden damage, rot, poor earlier work or soil problems, we'll stop, show you what we found and give you the added cost in writing before we go on. We won't do extra work you haven't approved.

Unless your estimate says otherwise, it's good for 30 days, since material prices change. Any figures on this website are general information, not a quote for your job.

Scheduling, weather and cancellation

We set a start date with you once you've accepted the estimate. Mortar and concrete need the right temperature and dry conditions to cure properly, so we may move a start date or pause work for freezing weather, rain, snow or high wind. We'll tell you as soon as we know and pick the next workable day with you.

Delays from weather, material shortages, permit timing or conditions we couldn't see beforehand aren't a breach of our agreement. Please give us clear access to the work area and let us know about pets, sprinklers, buried lines or anything else on the property we should know about.

If you need to cancel or reschedule, call us at (505) 303-0434 as early as you can. If you cancel after we've ordered materials or started work, you'll pay for materials we can't return and for work already done, plus any cancellation terms in your signed agreement.

Payment

Your estimate or contract sets out the payment schedule, including any deposit and when the balance is due. Unless it says otherwise, the final balance is due when the work is complete.

If a payment is late, we may pause work until it's made. Where New Mexico law allows, we may also charge reasonable collection costs and file a lien on the property for unpaid work and materials.

Our guarantee and what it doesn't cover

We stand behind our workmanship, and any specific warranty for your job will be written into your estimate or contract. Material warranties come from the makers of those materials, and we'll pass along what they give us.

Masonry and concrete change over time, so some things aren't defects. That includes hairline shrinkage cracks in concrete, small color differences between new and old brick, stone or mortar, efflorescence, which is the white powder that can rise to the surface, and normal weathering.

Our workmanship coverage doesn't extend to damage from ground movement, drainage or grading we didn't install, freeze-thaw from water you leave standing, de-icing salts, vehicles heavier than the work was built for, misuse, or changes and repairs made by others.

Apart from what's written into your agreement, we make no other warranties, express or implied, to the extent New Mexico law allows. The information on this website is given as is, for general use.

Limits on our liability

Our crew works carefully, but some existing conditions are out of our control. We aren't responsible for damage caused by hidden conditions we couldn't reasonably see, such as weak footings, failing older masonry or underground lines that weren't marked or disclosed to us.

To the extent the law allows, our total liability for any claim about a job is limited to the amount you paid us for that job. We aren't liable for indirect or consequential losses, such as lost use of the property or lost rent. Nothing here limits liability that New Mexico law doesn't allow us to limit.

If something goes wrong

If you're unhappy with any part of the work, call us first so we can come out, look and make it right. Most problems get settled that way.

If we can't settle it together within 30 days, either of us may take the matter to mediation or to a court in Santa Fe County, New Mexico, including small claims court where it qualifies.

Governing law

These terms and any work we do are governed by the laws of the State of New Mexico.

Changes to these terms

We may update this page from time to time. The version posted when you sign an estimate or contract is the one that applies to that job.
